TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of the Moto Hub Nation mobile application and website (motohubnation.com), operated by Moto Hub Nation LLC ("we," "us," or "our"). By accessing or using the app, you agree to be bound by these Terms.

1. Route Accuracy & Safe Riding Disclaimer

RIDER SAFETY IS YOUR RESPONSIBILITY. The Moto Hub Nation app provides telemetry, route mapping, and location-based services. You acknowledge that user-generated and app-provided routes may contain inaccuracies, road closures, construction, or dangerous road conditions. Weather and environmental factors can change rapidly.

You agree that you will not operate the mobile application in any way that distracts you from safely operating your motorcycle. Always obey all local traffic laws, speed limits, and road signs. We are strictly not liable for any accidents, injuries, property damage, or legal infractions that occur while using the app or traveling on routes suggested by the app or its users.

2. User Accounts & Digital Garage

To access certain features, you must register for an account. You agree to provide accurate information and keep your login credentials secure. We reserve the right to suspend or terminate accounts that provide false information, impersonate other riders, or violate community guidelines.

3. Private Messages & User Conduct

Moto Hub Nation provides encrypted direct messaging and group chat functionalities. Because these channels are encrypted, we do not actively monitor private communications. You agree that you are solely responsible for all content, data, and information you transmit via private messages.

We absolutely disclaim any liability for harassment, threats, illegal activities, or disputes that arise between users within private or group messages. You agree not to use our messaging services to transmit illegal, threatening, abusive, or malicious content (such as malware).

4. Events, Vendors & Groups (MC Chapters)

Moto Hub Nation acts solely as a digital platform to connect the motorcycle community. We do not endorse, vet, or background-check the individuals, motorcycle clubs (MCs), riding groups, vendors, or event organizers listed on the app.

• Events & Meetups: Attendance at any physical event, rally, or group ride organized or promoted through the app is strictly at your own risk. We are not liable for the safety, security, or legality of these real-world gatherings, nor are we responsible for event cancellations or refunds.
• Vendors: Any transactions, communications, or disputes between you and a third-party vendor found on Moto Hub Nation are solely between you and that vendor. We are not a party to these transactions and disclaim all liability regarding the quality of goods or services provided.
• Groups & Chapters: The formation or verification of a digital "Chapter" or "Group" on Moto Hub Nation does not imply sponsorship or endorsement by Moto Hub Nation LLC. We are not responsible for the real-world actions, rules, or liabilities of these independent groups.

5. Telemetry and Merit Patches

Our Merit Patch system relies on GPS telemetry and action usages in the application. While we strive for accuracy, we do not guarantee the precise calculation of mileage or borders. Merit Patches are digital achievements within the app and have no real-world monetary value. Any attempt to spoof GPS locations will result in immediate account termination.

6. Intellectual Property

All original content, features, and functionality of the app—including the Moto Hub Nation branding, digital Merit Patch designs, UI layouts, and code—are the exclusive property of Moto Hub Nation LLC and are protected by international copyright and trademark laws.

7. Limitation of Liability

To the maximum extent permitted by law, Moto Hub Nation LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of the application, reliance on its routing, or interactions with other users, groups, or vendors.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions.
